Terms of Service

These Terms of Service (“Terms”) govern your use of jasonmartinezart.com (the “Site”) and any purchase you make from it, operated by Jason Martinez Art LLC (“we,” “us”). By using the Site you agree to these Terms.

Use of the Site

You may browse and shop for your own personal, non-commercial use. You agree not to misuse the Site, interfere with its operation, attempt to access it in an unauthorized way, or use it in violation of any applicable law.

Intellectual property

All photography, artwork, designs, text, and other content on the Site are owned by Jason Martinez and are protected by copyright and other laws. Nothing on the Site grants you any license to reproduce, distribute, publicly display, sell, or create derivative works from the content without our prior written permission. Downloading, scraping, or reusing images is prohibited.

Products, orders, and pricing

  • Purchases are processed through Shopify and are also subject to Shopify’s checkout terms.
  • We strive for accuracy, but product descriptions, availability, and prices may contain errors and are subject to change without notice. We may refuse or cancel any order, including after an order is placed, for reasons such as pricing errors or stock issues; in that case we will refund any amount charged.
  • Prints and physical works may vary slightly from on-screen images due to display and production differences.
  • Sales are final for change of mind, as described in our Refund Policy. That does not cover an order that arrives damaged, arrives faulty, is not what you ordered, or never arrives, and it does not limit rights you have under consumer law that cannot be waived by agreement.
  • Production and delivery times, shipping costs, customs charges, and what to do about a damaged or missing parcel are set out in our Shipping Policy.

Copyright complaints (DMCA)

If you believe material on the Site infringes a copyright you own or control, email jason@jasonmartinezart.com with “DMCA takedown request” in the subject line. So that we can act on it, please include:

  • Your name, address, telephone number, and email address.
  • Identification of the work you say is infringed, and the URL of each page on the Site where the material you are complaining about appears.
  • A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  • Your physical or electronic signature.

We review every complete notice and remove or disable access to material we determine to be infringing. If your material was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to the same address with the same contact details, identifying the material and where it appeared, and stating under penalty of perjury that you have a good-faith belief it was removed in error. Notices that are sent in bad faith may carry liability under 17 U.S.C. § 512(f).

Open-source components

The Site is built with open-source software published under the MIT, ISC, Apache-2.0, and similar licenses, whose notices we are required to preserve. Those notices are collected in a file named THIRD-PARTY-NOTICES.md that ships with the Site’s source code; email jason@jasonmartinezart.com for a copy. Those licenses cover the software only — never the photography, artwork, or other content described above.

Disclaimer of warranties

The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any products purchased through it. Nothing in these Terms limits liability that cannot be limited under applicable law.

Third-party links

The Site may link to third-party sites and services (such as Instagram or Shopify). We are not responsible for the content or practices of those third parties.

Changes to these Terms

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
