Privacy Policy

This Privacy Policy explains how Jason Martinez Art LLC (“Jason Martinez Art,” “we,” “us”) collects, uses, and shares information when you visit jasonmartinezart.com (the “Site”), contact us, or purchase from our store. It describes what the Site actually does; where a service outside our control handles your data, we name it and link to its own policy.

Information we collect

  • Contact form. When you send a message we collect your first name, last name, email address, and the contents of your message. Your IP address is also used at that moment to rate-limit submissions and, where the anti-spam challenge is enabled, to verify it.
  • Orders. Purchases are processed by Shopify. When you check out, Shopify collects your name, billing and shipping address, email, and payment details. We receive order and fulfillment information but never see your full payment-card number.
  • Automatically. Our hosting and content-delivery providers receive the technical data every web request carries — IP address, browser and device type, referring page, and the URL requested — and record it in server logs for security, troubleshooting, and performance.
  • What we do not collect. The Site runs no analytics, advertising, or tracking package, sets no advertising cookies of its own, and does not build a profile of you across sites. We do not knowingly collect information from children under 13.

How we use your information

  • To respond to inquiries and provide customer support.
  • To process, fulfill, and deliver your orders.
  • To operate, secure, and troubleshoot the Site, including blocking automated abuse.
  • To send you updates or marketing only where you have opted in. Contact-form submissions are stored in the same customer-relationship system we use to send those mailings (see below), so a message you send us sits alongside our mailing list. We do not add you to a mailing without your opt-in, and every mailing carries an unsubscribe link.

Service providers who receive your data

We do not sell your personal information. We share it only with the providers below, each of which processes it on our behalf for the purpose named. All of them are based in the United States, so using the Site involves transferring your data there.

  • Shopify (privacy policy) — the store, cart, and checkout. Your browser talks to Shopify directly to build a cart, and checkout itself happens on a Shopify domain under Shopify’s terms. Shopify also serves product images and sets the cookies its checkout needs.
  • GoHighLevel (privacy policy) — our customer-relationship system. A contact-form submission is delivered to it as your name, email address, and message.
  • Resend (privacy policy) — a backup delivery route for the contact form. If the system above is unreachable, your message is emailed to us instead, with your address set as the reply-to.
  • Cloudflare (privacy policy) — images and video on the Site are delivered from Cloudflare Images and Cloudflare R2, so Cloudflare receives your IP address and browser details when media loads. The contact form can also require a Cloudflare Turnstile challenge; when it is enabled, Turnstile loads a widget in your browser, may store data there to complete the check, and receives your IP address along with the result. Turnstile is designed for this purpose and not for advertising.
  • Netlify (privacy policy) — hosting. Netlify serves the Site and runs the contact-form endpoint, and its server and function logs record request metadata and diagnostic records of form submissions.

We may also disclose information where we are legally required to, or to protect our rights or the security of the Site.

Browser storage

The Site itself sets no cookies. It stores three small values in your own browser, which stay on your device and are never sent to us:

  • shopify_cart_id (local storage) — the identifier of your Shopify cart, so your bag survives a reload. Cleared when the cart is emptied or Shopify reports it as no longer valid.
  • jm-motion-paused (local storage) — whether you used the pause control to stop the animated globe, so the choice sticks between visits.
  • globe-intro-seen (session storage) — whether the globe intro has already played in this tab. Discarded when you close the tab.

Separately, Shopify sets the cookies its checkout requires, and Cloudflare Turnstile may store data in your browser to run its anti-spam check. You can clear or block browser storage in your browser settings; the cart and those preferences will simply not persist.

Retention

We keep information for as long as it is needed for the purpose it was collected for, and after that for as long as we need it to meet legal, accounting, or dispute-resolution obligations. Contact-form submissions stay in our customer-relationship system so we have a record of the conversation; order records are retained by Shopify under its own policy; the request and function logs described above are retained by our hosting provider under its policy. We have not set a fixed deletion schedule for contact records, so if you want yours removed, ask us and we will do it.

Your choices and rights

Depending on where you live, you may have the right to request access to the personal information we hold about you, to have it corrected or deleted, to object to or restrict how we use it, to receive a copy of it, and to withdraw consent you have given. You can also unsubscribe from any marketing email using the link in that email.

To make any of these requests, email jason@jasonmartinezart.com. We may need to ask you for information that lets us match the request to our records. We do not charge for this and we will not treat you differently for asking.

Security

The Site is served over HTTPS and the contact endpoint validates and rate-limits what it accepts. No method of transmission or storage is completely secure, so please do not send us sensitive information — payment-card numbers, government identifiers, or health details — through the contact form.

Changes to this policy

We may update this policy from time to time. Material changes will be reflected by the “Last updated” date above.
